[WI] My mom overstayed her B2 visa and got deported. What can she do to visit me?

Hi! 10 years ago my mom got deported after living in Austin for 2 months. She had a B2 visa and hadn’t overstayed her permit time, but my brother (a minor) was studying in Austin.

Now I’m living in Milwaukee on an L1 visa, and my mom wants to try to get a tourist visa again to visit me.

With the B1/B2 visa in general, she would have to first reapply. The DS-160 form would need to be filed to request a new visa.

Given the deportation, she may also need to file Form I-212, which is a request for permission to reapply for admission into the U.S. after deportation.

She will also have to show:

  • Substantial ties to Mexico
  • Clear intent to return after her visit
