[FL] If someone owes me money, what are my legal options?

An old friend and cowoker owes me money. I am getting the run around. I want to know what my options are.

Okay then under Florida law you would have up to 4 years to sue the person in small claims court for the money if this was an oral agreement for the loan (Florida Statutes § 95.11(3)(j)).

The small claims limit in Florida is $8,000 so you don't have to hire an attorney and can pursue her in the lower courts for the money (Miami-Dade Clerk - Small Claims).

Was there any type of written agreement between both of you about the loan?

When was the money supposed to be repaid and have they refused to do so upon demand?

How long ago did you make the loan?

She said that she would sign something and then changed her mind. I have texts and emails.

Money was supposed to be repaid. The loan was made 2/12/2025

She was going to make payments of 350 a month.

Do I need to send her a written notice?

You can send her a written demand letter telling her that she has XX days to repay you the loan or you will be forced to take legal action to enforce the agreement.

That shows good faith on your side in that you tried to resolve this matter before taking it to court.
