[LA] How do I renew my driver’s license if I’m flagged for a cancelled insurance policy on a car I sold but I don’t have a bill of sale?

I live in Louisiana and need to get my driver’s license renewed. When I went to do so, I was flagged due to a cancelled insurance policy on a previous vehicle. I sold this vehicle to a car dealership in Memphis, Tennessee, on October 30, 2024. The state said I needed to provide them with a bill of sale, but I never filled one out. Is it okay to create one now and send it to the dealership to sign?

Okay. Yes, getting a bill of sale signed by the car dealership is a good first step. If the car dealership refuses to sign the bill of sale, you could threaten a claim against them since they are preventing you from removing the vehicle from your registration. You could also request documents showing they are going to list it for sale. Then, take this documentation to your local Office of Motor Vehicles.

I'm sorry to hear about the issue you're facing with your driver’s license renewal. Have you tried contacting the dealership in Memphis regarding the bill of sale?

I did. They said all that was signed was the Odometer Disclosure Statement and Power of Attorney for Vehicle Transfers.

Do you have any documentation or proof of the sale of the vehicle on October 30, 2024, such as a copy of the sales agreement or any communication with the dealership?

Those are all the documents I have. I have an email informing them that I sent them the title for the sale.

Is there anything else the consumer protection lawyer should know before I connect you?

That is all I have for now.

Welcome, and thank you for using AskaLawyer. My name is Liz, and I'm the attorney who will assist with your legal question. I know that dealing with the law can be incredibly stressful and challenging, so I’m here to help clarify and provide direction. Would the state accept a copy of the transferred title?

I no longer have the original title for the car. The hold states they would only accept the bill of sale as proof of why the insurance on the sold car was cancelled.

Have you spoken with the dealership?

Only regarding whether a bill of sale was signed. Should I fill out a PDF and send it to them and request they sign?

You could do so, but you do have to give it the current date. You can't legally postdate documents.

Thanks! I’m glad you said that. I put the date I sold it, so I’ll need to change that. If they refuse to sign for whatever reason, is there anything I can do?

Is the car listed for sale on their website?

Not that I see.

Ok, I’ll fill the PDF and send it to them and see what happens. If not, I will press them with that should they refuse to sign.

You could also request copies of all the sale records, just in case you need them. Is there anything else I can assist with or clarify?

I think that is it for now. I appreciate your help!
