[CT] Can I view an affidavit related to a search warrant?
Access to the affidavit depends on whether it’s sealed.
- If it’s not sealed, you (or your attorney) can request it from the court clerk.
- If it is sealed (to protect an investigation, witnesses, or confidential info), you can’t see it until a judge unseals it.
Through discovery, your defense attorney can usually obtain a copy unless a judge keeps parts sealed.

I understand you’re concerned about accessing the affidavit. Have you or your attorney already filed a request to view this document?
Not sure.

What specific details are you hoping to find in the affidavit that are important for your case?
I don't know.

Is there anything else the criminal lawyer should know before I connect you?
No.

Hey there! I’m Benjamin, an attorney with many years of experience. Have you or your attorney already filed a request to view it?
Not sure, I haven’t. I was given the two pages of the actual warrant but not the 13-page affidavit.

This is in Connecticut. Search warrant was served March 26. No further movement on the case. If it was going federal, would I have gotten some kind of information yet?
Benjamin
You’re notified if/when you’re charged with a federal crime. If the investigation was picked up by the feds, you wouldn’t be notified during the investigation.
I believe it is because I’ve heard nothing. Would you get notification if it was going federal?
Benjamin
You’d be notified only upon charges. There’s no requirement to notify you that you’re being investigated or by whom. Local PD can turn it over to the feds, or the feds can assume jurisdiction at any time.
Got it—and I would not know until I was charged.
Benjamin
Correct. Does that solve your issue? Let me know if you have further questions.
