The letter gets the main message across, but it can be stronger. It clearly identifies the property and demands its return, and it mentions possible legal action—those are good points.

But here’s where it can improve:

  • It doesn’t explain how the person came to have the car. Just saying “unlawful possession” isn’t enough—context strengthens your claim.
  • You should state the payment you sent for the promised engine replacement.
  • Set a deadline—e.g., “within 7 calendar days from the date of this letter”—instead of just “immediately.”
  • Include instructions on how and where the vehicle should be returned.
  • Send it by certified mail with a return receipt to have proof it was received.

AI

I understand you completed a demand letter for your BMW. Have you encountered any issues with the payment or transfer process?

Payment for what specifically?

AI

Have you received any response or feedback regarding the demand letter from the recipient?

I haven’t sent it yet.

AI

Is there anything else the lawyer should know before I connect you?

The jurisdiction is in Texas.

Jon

Hello! I’m Jon, and I’ll assist you. I understand dealing with this can be stressful—don’t worry, I’m here to help. What question about the letter did you have?

Please review my demand letter for an automotive shop in Houston, Texas. A detective requested it so the police can check on my car and retrieve it or demand its return.

Jon

Okay, please copy/paste the wording here.

REQUEST TO RETURN PERSONAL PROPERTY

RE: DEMAND FOR THE RETURN OF PERSONAL PROPERTY

Dear Joe,

This is an official notice to make it known that you are in unlawful possession of the following property:

2014 BMW 650i Gran Coupe

I demand that you return the aforementioned property immediately. You do not have the right to keep my property and you are legally required to return it at your expense.

If there is no response to this letter, all legal rights will be explored, including, but not limited to, legal proceedings necessary to recover the property.

As already mentioned, this demand letter for personal property serves as official notice to you and may be tendered in court as evidence of your failure to return the property. If legal action is to occur, it may involve having you pay attorney’s fees.

It is in the best interest of all parties to resolve this matter as soon as possible.

An amount of $9,300 was paid, in advance, for a brand-new engine installation.

Jon

That’s important. It clarifies that you paid for a service that wasn’t completed and ties the money directly to your demand.

I also have an email with all details that I sent to Stafford Police and eBay (where the service contract originated). Can I post the full letter here?

Jon

You can use the contents of that email in your demand letter—it strengthens your case. It shows you’ve already reported the issue and have documentation. Keep that email, your wire transfer receipt, and certified mail receipts as part of your records.

What would it cost to adjust and incorporate what’s necessary to make the letter stronger? Can I get a copy of this transcript?

Jon

I’m sorry, but I can’t prepare or adjust documents for you here, nor provide transcripts. A local lawyer would have to do that. You can copy/paste this chat for your records.

I appreciate the courtesy.

Jon

Glad I could help. I hope this addressed your concerns—let me know if you need anything else.
