[TX] How does a marital settlement agreement become effective?

TX Divorce

Hello, what additional documents do we need to add to this form, and where should we send them? Do I need a birth certificate or lease agreement (to verify address) right now? And where exactly do we send this form?

Solved

A marital separation agreement, or property settlement agreement, is a written contract that divides property and spells out rights and responsibilities, such as alimony and custody (Texas Family Code § 7.006).

You don’t usually need to file it with the court for it to be effective. But once both parties sign it, it can be filed with the clerk in your local district court’s family law section. The court will review it, and if it is approved, it’ll become part of the final divorce decree.

It is not necessary at this point to file a birth certificate or lease agreement. If/when you file your petition for divorce, those items may be required. For now, if you plan to file, you’ll need to physically go to the court and file the agreement with the clerk.

Hello. My name is Benjamin, and I’ve been a licensed attorney for over 19 years. I look forward to assisting you. Could you let me know what the form number is and what state you're in?

I'm not sure about the form number. It says “Texas Marital Settlement Agreement.” I’m in Irving, Texas, but my driver's license is from Florida. I’ve been here for over three years.

I haven’t filed the petition for divorce. I thought it was enough (and faster) with just the settlement.

No, the marital settlement agreement is only a preliminary agreement. To legally end your marriage, you must file for and be granted a divorce.

So what should I do first?

Benjamin

You can file the marital settlement agreement now to set the terms for your eventual divorce. But if you’re ready to proceed with the divorce itself, you’ll need to file one of the following packets based on your situation:

Choose the one that fits your case and file it with the court.
