Yes, my spouse agrees to a legal separation. She does not want spousal support and agrees to sign a quitclaim deed. Her name is not on the property, but we did do our taxes jointly married, so I believe she does have a claim to part of the house. So for 1 — legal separation is not like a prenup. If you get back together, the separation agreement could be canceled. This means the assets could be redivided if you divorce or separate again.

For 2 — A quitclaim would have to divest the person of all rights, but if you reconcile, that could create a new interest in the property. At that point, a postnuptial agreement could help protect it.

For 3 — If she wants to delay, you may have to offer her more assets to get her to agree. For the house, the increase in equity would usually be what she can claim since it’s pre-marital.

For 4 — The time starts when the marriage was legal with the state, which is the civil marriage.

I heard a lawyer on YouTube say that when a party does the quitclaim deed it has to be worded a certain way on the legal separation paperwork so that it cannot be undone. Is that true?
