I need my spouse to notarize divorce papers who lives in a different State, do they need to notarize in my State or can they notarize the documents there?

All I need to do now is send the papers to my spouse, have him sign and get notarized where he is, mail them back to me, and then I sign and get notarized—or does he have to sign here in North Carolina by both parties?

No, he can sign them out of state and have them notarized in that state, then mail them back to you.

They don’t have to be signed in North CarolinaThe notary just marks through the state and notarizes them where he is located.

This would not be a problem.

I understand you’re in the process of filing for divorce. Have you and your spouse discussed where the papers need to be signed and notarized?

No. He is in West Virginia, I am in North Carolina.

Are there any specific instructions regarding the location for signing and notarizing the divorce papers in your state?

Unknown… I filled out the forms but didn’t see anything that stated where it can be signed.
