I want to ask a real lawyer a question about how to resign from my job where I am being bullied by the office manager. Her husband is the owner and a lawyer. Her son is partner and a lawyer. She faces no consequences for her actions. They just gave me a $20,000 raise because they want me to know how valuable I am to the firm (I'm a paralegal). I have no time to take breaks, work sick—sometimes even going home after working for one hour because I am so sick, given an unrealistic workload etc. I am looking for a new job and I'm planning my exit. I've written a draft resignation letter and I need help figuring out how to resign. The office manager likes letters hand-delivered to her, but she’s the one who bullies me. The husband and son are owners; the letters are addressed to the two of them but given to her, then emailed to all three.

I want to sue my employer for unpaid wages. They’re being taken over by a larger company, so I’m suing both. Are these causes of action acceptable? Breach of contract for unpaid wages. Wage theft/failure to pay wages per the employment agreement, leading to vehicle repossession and late fees (Nat’l Mkt. Share, Inc. v. Sterling Nat’l Bank, 392 F.3d 520, 525 (2d Cir. 2004)). Fraud—deceptive practices about payroll, W-2s, employer business taxes, and debts to health insurers. Unjust enrichment—kept benefits without paying me; debt collectors contacted me, lowered my credit score—intentional infliction of emotional distress. Violation of Labor Law; Fair Labor Standards Act.

I’m not sure if I’m barking up the wrong tree, but I started a petition of no confidence at work. We have a director who fired a manager who stood up for employees and is pushing new rules without staff input. We’re nurses with a union, but the union’s been lackluster. A coworker suggested getting a lawyer to sign off or at least give advice. The union is aware and okay with the petition. I have a lot of support in my unit, but I’m the one fronting the paperwork.

It’s been a year since I was wrongfully terminated. I couldn’t sue immediately due to lack of financial stability. Now I have the ability to sue them. Is it still possible for me to sue for this, given the issues this has caused me and my wife over the past calendar year?
