[VA] [VA] Do POA forms need witnesses and can they be signed from another state?
Virginia law doesn’t require witnesses for a general or durable POA (Va. Code § 64.2-1601). Only a healthcare/medical POA needs two witnesses. A financial POA only needs the principal to sign before a notary (Va. Code § 64.2-1602).

Does the Virginia POA form need two witnesses? Also, I am in Colorado and printed a form to forward to a friend in Virginia. I see that page 12 requires my signature as agent — can I manually sign or do I also need that page notarized?
I understand that navigating Power of Attorney requirements can be confusing. Can you confirm you’re asking about Virginia’s POA laws?
My brother lives in Virginia, so I printed a form for Virginia (he is in the hospital in Washington, D.C.).
Are you completing this form for someone else?
Form is for my brother.
Anything else the lawyer should know?
Not that I can think of, thanks.
Hi, I’m Randy. Happy to assist. Your brother just needs the financial POA and not medical?
Sorry, I can’t seem to go back — do I need one or two witnesses for a Virginia POA, and can I manually sign page 12 as agent? Does my signature need to be notarized before I forward the document for notarization in Virginia?
Virginia law doesn’t require witnesses for a general or durable POA (Va. Code § 64.2-1601). Only a healthcare/medical POA needs two witnesses. A financial POA only needs the principal to sign before a notary (Va. Code § 64.2-1602).
We do have the medical POA — not sure why this wasn’t done earlier.
The statute says the principal must sign, preferably notarized. The medical POA is the one requiring the two witnesses.
So if I manually sign the page with my name, is that adequate? I'm in Colorado.
Yes. Your signature as agent isn’t required for validity. A handwritten (wet-ink) signature is acceptable. It does not need to be notarized. You can sign anytime after your brother signs and gets notarized.
Okay, thank you for your time!
You're very welcome!
Thank you, I think this is all the info I need.
My pleasure. Have a great day!
