My mom has Alzheimer's. My father was her proxy, but he passed suddenly in January. Now my brother has her medical proxy, which became effective after Dad's death. Mom and Dad have a trust set up, which puts her in charge, but she can’t handle banking, retirement, or other personal affairs anymore. We attempted to have her sign a POA, but when the notary asked if she knew why she was there, she said no, so the notary couldn’t proceed. What are our options?

My brother, Julius, is the successor trustee. My dad's retirement plan won't accept the trust and won't proceed without a POA. The credit union will also not let Julius take control until it has proof that she is unable to manage her affairs.

1. Get a Doctor's Statement of Incapacity

  • Request an official letter from her doctor stating she has Alzheimer's and cannot manage financial matters.
  • Some banks/retirement plans may require two doctors, so it's a good idea to verify their policies.

2. Submit Statement

  • Once received, submit the statement to the institutions in which your mother and father kept the assets you want to manage. This should trigger access under the trust.

3. If Retirement Plan Won't Accept the Trust

  • Some plans require a power of attorney document and won't work with a trust.
  • Ask about their incapacity process. Some accept court-appointed conservators instead.

4. File for Conservatorship If Necessary

  • If they still block access, Julius should file for conservatorship.
