Husband’s parents both died within 32 days of each other. They have no real estate or property other than small personal items, leaving only the contents of their checking account, total less than $7100 (or less, depending on whether or not Social Security retracts some funds). I have drafted separate Small Estate Affidavits for each. My question is this: in their wills, my husband is the only stated heir. They have a second son, noted in the will, not named as an heir. Is the affidavit sufficient?

Hi, my husband passed away last Sunday and the bank is requesting a new certificate of trust since the last one was in 2001. We have a living trust and I filled in the grantor with myself and my husband as grantors as stated in our trust. Do I just need to have it notarized and take it back to the bank, or do I need to take it to my attorney? Thanks for your help.

I am the sole beneficiary of my brother’s estate and have been made personal representative through probate. I’m being told I need a Personal Representative Deed to transfer the house into my name. I already have a general warranty deed, a quitclaim deed, and the testamentary papers. Is this true, and what else do I need?

My mom passed away in March. She had no assets other than her checking account. She has a bit over $2000 in that account and I have a check for a bit over $1800 for an overpayment on her nursing home. I was her POA. She had a living will but no will that named an executor or executrix. I just want to be able to cash this check and close her checking account without too much legal expense and hassle. I was told that I would need to have her will admitted to Probate and be sworn in as Executrix, then open a checking account in the name of her estate, just to be able to cash the check.
