Which court has jurisdiction over my child’s name change if we live in different states?

I have a son in another state, and the mother wants to change his name. I’m in Oregon, and she’s in Pennsylvania. Which state would we get a lawyer from to initiate the name change? My son is also in Pennsylvania.

The court where the child has resided for the past six months would have jurisdiction. This is under the "home state rule" under the Uniform Child Custody Jurisdiction and Enforcement Act. (UCCJEA, §102(7))

I understand your concern about the potential name change for your son. In which state is your son currently residing, Oregon or Pennsylvania?

Pennsylvania.

Have you and the mother of your son discussed this proposed name change, and are you both in agreement about it?

Yes.

Is there anything else the Family Lawyer should know before I connect you? Rest assured they'll be able to help with the name change.

That’d be all for now.

Is there a court with current jurisdiction over custody issues?

We aren’t battling custody, no. My son's mom and I want to change his name to her surname. We want to know if she should get a lawyer in Pennsylvania or Oregon since both she and my son are in Pennsylvania.

I understand. Just to clarify, are you aware of any courts in her area currently having jurisdiction?

I’m unsure of the courts in her area at the moment. I’m just starting to look into how to start the process now. He was born in Indiana if that has any bearing, but he legally resides in Pennsylvania.

He’s currently 3 years old.

Would this be within the county or within the city?

It would be within the county, as that is how the judicial system is set up.
