Under New Jersey’s relocation statute (N.J.S.A. 9:2-2), how will the court evaluate my request to move my minor son and me from my rent-free, stable residence at his maternal grandparents’ home in Mount Laurel—where I serve as his sole daily caregiver, work steadily, maintain savings and school continuity, and benefit from an established local support network—against the proposed relocation to California, where we would gain a larger extended-family support system and new employment opportunities but sacrifice Gideon’s existing schooling and childcare stability?

1. Does Idaho law (Rule 120) support my position that child care during medical leave qualifies as “work-related” due to temporary incapacity? 2. Can the other parent be legally required to pay their share even if I wasn’t working but was medically incapacitated? 3. Is the court likely to view my decision to maintain child care as reasonable and necessary under the decree?

I have an upcoming child custody hearing. I live in Huntington, West Virginia. The court case is in Stephens City, Virginia. The mother has made up a lot of lies that caused my custody to be temporarily suspended. I’ve done a lot of community service work for over a decade, and this has caused extreme stress on our children, our relationship, and our ministry. She venue-shopped until she got a favorable outcome, mainly due to my inability to present proof properly in court. But I do have everything well documented. I just need someone to walk me through this process. I’m unfamiliar with it, and it’s even more difficult because I live so far away. I have evidence and witnesses willing to travel with me.

I’m seeking full custody of my son, not to keep him from his mother, but to ensure his stability and access to early intervention services through his current school. His mother chose to separate and pursue divorce, which is her right, but her actions since—including inconsistent involvement and an unstable housing situation—have raised concerns. I currently live with her parents, and they support me staying here with my son. Given all of this, and the possibility that I may need to move in the near future, how would I pursue full or sole legal custody while still ensuring his mother has visitation? What steps would strengthen my case, and what specific documentation should I begin compiling?
