Will I be held in contempt for keeping my child away from the other parent to protect her from alleged sexual abuse?

If you keep your daughter from the other parent because the child is telling you that her sister at the other parent’s house is sexually abusing her, can you be held in contempt, and what are the consequences of contempt?

You should call 911 and have the police and Children’s Services investigate all of this.

Doing so provides protection from any motion for contempt. The police may also be able to support a modification of custody.

The best step is to get the authorities involved immediately.

If you report it, they may deny visits and you can seek to modify custody and cut off visitation.

You need someone to validate the situation and protect the child from further abuse.

I’m sorry to hear about the difficult situation you’re facing. Has your daughter disclosed this abuse to anyone else besides you?

Yes, her grandmother.

Are there any ongoing legal agreements or court orders regarding custody or visitation rights in place?

It’s 50/50 custody, and he was supposed to pick her up today, but the mother did not let the daughter go back to the father’s because of what the daughter has been telling her.

Is there anything else the family lawyer should know before I connect you? Rest assured they’ll be able to help with interference with custody.

Yes.

What specific details has your daughter shared about the alleged abuse, and how has she expressed her feelings about it?

Have you or her grandmother taken any steps to report this situation to the authorities or seek professional help for your daughter?

How has the father responded to the allegations, and what is his current stance regarding custody and visitation?

There was a police report filed today, and a PFA (Protection From Abuse) is being filed tomorrow along with an emergency custody order.

The grandmother (the father’s mother) is going to testify at the PFA hearing. The father is trying to say that it’s because the mother has a girlfriend and that’s why the daughter “messes with her sisters.” He always gets mad and never believes the daughter. There’s a lot to it.

He said he’s filing contempt tomorrow.

What do you think the judge will do in the contempt hearing after what I explained to you?

Ray

Ray

I think the judge may try to protect the child from abuse and could restrict the father’s visitation. This is serious and involves a clear danger to the child.
