[NJ] [NJ] How many days’ notice do I have to give my month-to-month tenant?

I have a tenant in NJ. No lease. I’m selling the house. I plan on giving her a 30-day vacate letter.

In New Jersey, if there’s no written lease and the tenant has been there more than a year, you should give 60 days’ written notice to terminate the tenancy (30 days is generally for under a year). Since your tenant has been in place for 2 years, give 60 days’ notice (N.J.S.A. 2A:18-61.2(f)). If they don’t vacate after that, you’d proceed with an eviction filing. Does that make sense?

I have a tenant, no written lease (oral lease). I’m selling the house. Should I give her 30 or 60 days’ notice to vacate?
