How do I break my lease?

I need to break my lease with 4 months left. The lease says 60-day notice plus 2 months’ rent to break. What can I do?

If your signed lease requires 60-day notice plus 2 months’ rent, you’re generally bound unless: (1) they agree to release you early, (2) they waive the fee, or (3) you don’t vacate. Job changes aren’t an exception (military orders are).

Have you discussed this with your landlord?

I spoke with the apartment manager.

I’ve been a licensed attorney for 19+ years. Has the property manager been willing to negotiate an early release?

No. They got a nasty attitude when I pressed. They said they’d let me know yesterday, didn’t, and I had to keep calling.

I have 4 months left. Their 60-day notice plus 2–3 months’ extra rent basically equals the remaining term. I need to break it by next month. I can pay the fees but don’t have 60 days.

You’ll still be obligated for the remaining 4 months to complete the term. You can give notice but not vacate until the end, absent their agreement.

So there’s nothing I can do?

Benjamin

Benjamin

No—there’s nothing you can do to terminate without following the contract terms unless they agree.

Alright then. Thanks.
