This power of attorney agreement assigns POA to me, and then to my brother if I am no longer able to serve as Agent. In other words he would be my successor. My question is this: Who needs to sign in front of a notary to create the POA? I think just my mother and myself. My brother would sign in the case when he needs to assume POA. Is that correct?

The properties are four lots that were given to my great-aunt in a general warranty deed by her husband, my great-uncle. In the general warranty deed they were given all at once in one deed, and I am copying the description from that. But I was told that you need to have four separate quitclaim deeds for each property since each has an address.

I am in Beaumont, TX and have a 2-year-old. I have no custody plan in place and her dad has been inconsistent, has not financially supported at all, is mentally unstable, and has had some scary moments around me and my daughter. I am on a limited budget and want to do it the best way I can for her while looking out for money as well. I know/think I need to file a SAPCR. I have not gone to the attorney general due to being afraid of what the outcome with her dad would look like. I just need advice.
