This happened during work—it's a workers’ compensation claim. Can they deny it because of that statement? I was alert, driving between hospice patients at 12:45 p.m. I fractured my sternum and three ribs and was hospitalized two days. I’m worried they’ll deny my claim.

Massachusetts workers’ comp is no-fault for injuries arising out of and in the course of employment. Traveling between patients is typically covered. A disputed “I fell asleep/looked down” line usually doesn’t defeat a claim unless there’s serious and willful misconduct (e.g., intoxication or criminal behavior). Provide your correction email and a short statement to the insurer, follow medical treatment, and if denied, file a Form 110 (Employee Claim) with the DIA.

If he won’t “amend,” ask specifically for a supplemental report or addendum noting the disputed quote came secondhand and wasn’t confirmed with you. File your own sworn statement with attachments and ask that it be added to the incident file. One disputed sentence alone shouldn’t sink a legitimate workers’ comp claim.
