I was in a class action lawsuit in a HOA and I understand the board members cannot be held liable. We do not have a property management company. Our board consist of seven volunteers. Long story short, instead of giving money back to the class members, it was decided to put the money aside and use for our private roads and ditches that are in desperate need of repair. I live in a small community of 450 homes and 1 acre lots. We have a bully for a president and he controls everybody’s opinion on the board. Yesterday he posted on a community website the statement: this is rich coming from a couple who have lived here for many years and have done nothing productive for the HOA. The only thing they have accomplished is to join the contractor lawsuit against the HOA resulting charge of $150,000 in attorney fee could’ve paid a mile of road or fixed and cleaned out a couple miles of ditches for stormwater. Speaking for myself I have done more for this HOA just today than they have done in 25 years. They are happy when they are sewing discontent or spewing conspiracy theories about how corrupt the current Board of Directors are. Listen to them if you must but whenever they post anything on here or their Facebook page know it’s to cause grief about things they have no idea about. Everything in the statement is false. I’ve only lived in the community since 2021. The lawsuit took three years and I never spoke to board members or residents because of the length they lost it. I’m very professional and keep my letters professional, asking questions that any resident in here would ask the Board of Directors.

Spoke to you recently on the general page. I feel it’s not slander—I can’t prove any slander—but the HOA president wrote a statement on our community website. Because he wasn’t upfront about a recent lawsuit, people I’ve never met are now haters, saying we’re harassing people (false). We only say “hi” to folks. I was told we’re not welcome in a resident-led “Community group,” and I got a Messenger note saying we’re not welcome to help with small improvements. During litigation we couldn’t correct rumors, so it stuck in people’s minds.

Florida Statute 943.0438 — Athletic Coaches for Independent Sanctioning Authorities — states that background checks should be conducted by a nongovernmental agency, which should be the football league. Our city is saying they are responsible for this, despite the Florida statute. This is important because the statute allows for coaches to go through an exemption process, which the city says they are not obligated to do under their statute.

Do I need a trust to preserve my benefits ($700/mo General Assistance; SSI pending)? I’m about to get a ~$12k settlement, but I’ll leave for Canada in 2–3 months (likely asylum). Should I use a Special Needs Trust? Could the settlement attorney do a disbursing agreement to keep me under the notification limit (~$1,260?) until I’m in Canada? Once I’m abroad, San Francisco will end GA anyway.

So I had a real U.S. Treasury Department tax check from 2023 that I was trying to cash at BMO Bank. They wouldn’t deposit it at the time due to racial discrimination against me and didn’t believe the check was real. Is there a possibility that I can seek litigation beyond that matter, or is it too late? I didn’t know what to do at the time, so I endorsed it into my roommate’s account — and he stole it from me.
