Subject: Cease and Desist – Unlawful Tree Removal Activities

To Whom It May Concern:

I am a homeowner and resident of [Your Neighborhood/HOA Name], and I am writing to formally demand that the HOA Board immediately CEASE AND DESIST from any further removal of trees within our neighborhood common areas and community property.

It has come to the attention of myself and several concerned residents that the Board, without a full vote of all members, required permitting, or input from the broader community, has already authorized the removal of at least 7–10 mature trees and intends to cut down over 90 more. This action appears to have been initiated solely by two board members, without a quorum or majority approval, and without adherence to proper procedural and legal protocols.

Specifically:

  • Lack of due process and resident consultation.
  • Apparent violation of board governance rules (no majority/quorum).
  • Failure to obtain required permits (to the best of our knowledge).
  • No environmental or mitigation plan provided (replanting, erosion control, etc.).

These actions threaten the ecological integrity and aesthetic character of our neighborhood and may expose the HOA and individual board members to legal liability.

Accordingly, I demand the following:

  1. Immediate cessation of all tree removal activities.
  2. A full accounting of all trees already removed (justification, authorization, contractor info).
  3. An emergency board meeting open to all homeowners to discuss and review procedures.
  4. Suspension of further tree work until permits are secured, residents are consulted, and a transparent plan is approved per HOA bylaws.

Should this unauthorized action continue, I and other residents are prepared to pursue all appropriate legal remedies, including injunctions, reporting to code enforcement, seeking damages, and pursuing recall or censure of responsible board members.

Please consider this letter a formal notice. If tree removal does not cease immediately, further legal action will be taken without additional warning.

I understand you need help with your cease-and-desist letter. Have you already sent it to the recipient?

No.

Could you please explain the main reasons for sending the cease-and-desist letter?

Our neighborhood HOA board has decided to cut down over 90 mature trees because they are frightened of a Pacific Palisades-type fire. Without consulting residents or getting the required permits and without a plan to replace the trees, basically, two board members have decided this needs to be done. The board's composition is four people with two for the tree cutting and two against. A fifth board member never goes to the meeting. The tree cutting started yesterday, and they have cut down at least 7–10.

Is there anything else the lawyer should know before I connect you?

I think that covers it.

Dear Board:

We demand the tree cutting project in the neighborhood cease immediately until such time as all residents can be informed in writing.
